WIPO Arbitration and Mediation Shanghai Service Initiates “Court-referred Mediation Promotion Scheme”

为进一步推广WIPO仲裁与调解上海中心（“WIPO上海中心”）与上海知识产权法院、上海市浦东新区人民法院所展开的合作，同时尽可能降低当事人在新冠肺炎疫情期间解决知识产权争议的难度，WIPO上海中心正式启动“法院委派/委托调解推广计划”：如双方当事人于2021年2月28日之前（含当日）合意将其正在由上海知识产权法院或上海市浦东新区人民法院审理的涉外知识产权争议提交WIPO进行调解，在征得具体案件中被指定的调解员同意的前提下，将为当事人提供免收调解员费及管理费的调解服务，并可免费使用WIPO仲裁与调解中心提供的eADR平台及视频会议设备。

To promote the new cooperation in mediation of foreign-related IP cases pending with the Shanghai IP Court and the Shanghai Pudong New District Court and to help parties lower barriers to resolving IP disputes under the present circumstances of COVID-19, the WIPO Arbitration and Mediation Shanghai Service (the “WIPO Shanghai Service”) initiates a “Court-referred Mediation Promotion Scheme”, i.e. subject to the agreement of the mediator appointed in the specific case, the mediator’s fees and the administration fee charged in that case will be exempted if parties involved agree to submit their foreign-related IP disputes pending with the two courts to WIPO mediation until February 28, 2021. Parties also have the option of using the WIPO Arbitration and Mediation Center’s time and cost efficient eADR and videoconferencing facilities, at no cost.

1、接受中国上海有关法院委派或委托进行的涉外知识产权案件调解

Mediation for Foreign-related Intellectual Property Disputes Pending before Courts in China

中国最高人民法院与世界知识产权组织（“WIPO”）于2017年4月签署谅解备忘录，建立合作框架。该备忘录下的一系列合作项目中包括，最高人民法院将与WIPO仲裁与调解中心在调解领域开展合作，以促进在中国境内的知识产权和技术争议的解决。2019年10月，中国司法部准予WIPO仲裁与调解上海中心在中国境内为涉外知识产权争议提供调解和仲裁服务。目前，接受上海有关法院委托，为正在审理中的涉外知识产权案件进行调解的具体合作已经展开。

A framework collaboration between the Supreme People’s Court of China (SPC) and WIPO has been established upon the signing of a Memorandum of Understanding (MoU) in April 2017. Among a number of activities involving WIPO under the MoU, SPC and the WIPO Arbitration and Mediation Center collaborate in the area of mediation to help resolve IP disputes in China. In October 2019, the WIPO Arbitration and Mediation Shanghai Service has been accredited by the Ministry of Justice of China to provide foreign-related mediation and arbitration services for foreign-related IP disputes in China. Cooperation has commenced concerning mediation of foreign-related IP cases pending with relevant courts in Shanghai.

截至2020年12月31日，中心共受理18起由上海法院委派或委托的涉外知识产权争议调解案件。其中，四起案件已完成实质调解（三起案件中当事人达成和解，和解率达75%）。

By December 31, 2020, the WIPO Shanghai Service has received in total 18 foreign-related IP mediation cases referred from courts in Shanghai. To date, substantive mediation proceedings have been conducted in four out of these 18 cases. Out of these four cases, three were settled, resulting in a settlement rate of 75%.
